General Terms and Conditions

1. Contract conclusion

  • The Buchenwald and Mittelbau-Dora Memorials Foundation, a foundation under the public law in 99427 Weimar, (hereinafter referred to as "foundation") agrees with the purchaser that the following general terms of payment and delivery will be recognized as applicable. For this and all subsequent business transactions with the purchaser, the following terms and conditions will apply exclusively. Any other terms or conditions on the part of the purchaser will be valid only if special individual arrangements are made.

  • Our terms and conditions will be deemed to be accepted by the purchaser when the online order form is sent. Any special individual arrangements at variance with the terms and conditions must be made mutually in writing.

  • Unless otherwise agreed in writing, our prices are fundamentally subject to change with regard to design, quantity, price, delivery time and delivery options.

  • Delivery contracts are concluded either through our electronic order confirmation by e-mail following the placement of the order by the purchaser, or through our delivery. All oral agreements, especially secondary and supplementary agreements, also those concerning the fulfilment of the order, will be valid only with our separate written confirmation.

  • We do not save the contractual text and it cannot be accessed after the order process has been concluded. The purchaser can print out the order data immediately after placing the order. The purchaser will moreover receive an order confirmation containing all order data by e-mail, provided he has entered the correct e-mail address. The receipt of the confirmation moreover requires the technical accessibility of his e-mail inbox.

  • The online shop of our foundation is presently available only in German and English.

2. Sales prices

  • The prices quoted include the currently valid German value-added tax and do not include the shipping costs.

  • If more than four months have expired between the order and the delivery without our being in delay of performance, we are entitled at the end of four months to pass on any increase in our list prices to the purchaser. A price increase of this kind does not require the consent of the purchaser. The prices stated in the order confirmation, however, are binding.

3. Delivery and shipping costs

3.1 Within Germany

  • Orders can be placed with the online shop of our foundation from within Germany against advance payment or on account.

  • Uninsured shipment within Germany costs € 4.90 per order for postage and packaging. The shipping costs will be charged only once, even in the event that partial deliveries are necessary.

  • The general term of delivery is five working days after receipt of the order. We check the order for stock availability and inform the purchaser by e-mail if items included in the order cannot be delivered in the short term. A binding shipment date can arise only from the order confirmation or other individual communication. No compensation will be made for delayed deliveries unless we have acted with gross negligence. The delivery is handled by the Deutsche Post DHL (German Post Office).

3.2 Outside Germany

3.3 Invoice

  • The purchaser will receive the invoice with the ordered merchandise.

4. Terms of payment

  • For orders placed from within Germany, payment can be made in advance, on account, or by way of the payment methods offered by Amazon Payments. For the Amazon Payments, Inc. Customer Agreement click here.

  • Payment is due within fourteen days after the invoice is issued.

5. Reservation of title and security for receivables

  • The merchandise will remain the property of the foundation until full payment of the agreed purchase price. The purchaser may resell the products subject to such reservation of title by the foundation, and the purchaser will promptly assign to the foundation any claim against its purchasers arising out of or in connection with the resale of the products up to a maximum of the outstanding amount of the purchase price. The purchaser is obligated to inform the foundation immediately of compulsory enforcement measures or to report to the police immediately any infringement on the property rights.

6. Cancellation policy

6.1 Right of cancellation

  • The purchaser has the right to cancel this contract without statement of reasons within fourteen days.
  • The cancellation period is fourteen days from the day the purchaser or a third party designated by him, other than the carrier, takes possession of the goods.
  • To exercise his right of cancellation, the purchaser must inform the foundation of his decision to cancel this contract by way of a clear and unambiguous statement (e.g. a letter sent by mail, a telefax or an E-mail). The statement is to be addressed to:

  • To comply with the cancellation period, it suffices for the purchaser to send the notification of his exercise of the right of cancellation before the cancellation period has expired.

6.2 Consequences of cancellation

  • In the event of an effective cancellation, the mutually received services are to be returned and, if applicable, advantages drawn from the services are to be surrendered. In the event that the purchaser cannot return the service received in whole or in part or only in an inferior state, he will be obliged to compensate us for any depreciation in value, if applicable. This will not apply to the surrender of merchandise to the extent that the deterioration of the merchandise is due exclusively to its inspection in the manner that would have been possible for the purchaser in a shop. Shrink-wrapped or sealed data carriers (e.g. CDs, VHS videos, DVDs and Blu-rays) will only be accepted if the shrink wrapping is unopened / the seal is intact.

  • The purchaser will bear the regular shipping costs for the return of the merchandise if the merchandise delivered corresponds to that which has been ordered and if the price of the returned merchandise does not exceed 40 EUR or when, in the case of a higher price, the purchaser has not yet effected payment or a contractually agreed partial payment at the time of the cancellation.

  • Obligations with regard to the reimbursement of payments must be fulfilled within thirty days. The term begins for the purchaser at the time of the dispatch of the merchandise, for the foundation at the time of the receipt of the merchandise.

7. Warranty

  • Within the two-year term of warranty we reserve the right to rectification free of charge. Only after the failure of the rectification is the purchaser entitled to the warranty claims of rescission of the sale or the reduction of the purchasing price.

  • This warranty is limited to the merchandise delivered, not to consequential damages or defects resulting from improper treatment or natural wear.

8. Liability

  • The foundation is not liable for manufacturer warranties. We are not liable for damages resulting from improper use of the merchandise or external factors. Liability for consequential damage caused by a defect is excluded.

  • For damages from the product liability – personal and material damages – the liability is restricted in the sense that the foundation will assign claims on the manufacturer or upstream trader to the aggrieved party.

9. Data protection

  • The foundation stores personal data necessary to process the purchaser's order(s). This data includes the purchaser's address, telephone number and e-mail address. Within the framework of the purchaser's orders, the respective order data (item, quantity, price) is moreover assigned to the purchaser's address data.

  • We assure the purchaser that this data will not under any circumstances be passed on to any third party. Only for the processing of the purchaser's orders will data be passed on to, for example, the Deutsche Post DHL (German Post Office) within the framework of the necessary working steps. The foundation will not make customer data available to third parties outside the foundation.

10. Jurisdiction clause

  • The place of jurisdiction is Weimar provided the object of the claim is a mutual commercial transaction.

  • Regarding all legal relations between the foundation and the customer, the law of the Federal Republic of Germany will apply with the exception of the "Vienna Sales Convention" 1980 (CISG), even if the customer has his domicile or business headquarters abroad.

11. Severability clause

  • Should one of these provisions be invalid, this will not affect the validity of the other provisions. The invalid provision is to be replaced by a provision that most closely approximates the intended commercial purpose of the provision in question.
